North Dakota approved a ballot measure in June that would stop people in their 70s from running for Congress in the state.

The vote was described as a “potential test case for the nation” by the Associated Press, as it bars people from running or serving in the U.S. House or Senate if they turn 81 during their prospective term. “This is really the picky stuff of a law professor now, of the ‘who actually gets to get into the courthouse door?” Hamline University political science professor David Schultz told the outlet. He added that a key to challenge the law would be those with standing to bring a claim, and if they can bring it all the way to the U.S. Supreme Court. “I wouldn’t be surprised if a ton of money appears on both sides as it moves up the appellate chain because I suspect there are interests on both sides here that would like to see the law upheld and like to see the law struck down,” he continued.

But What About Term Limits?

“Two-thirds of Americans agree that there should be upper-age limits for service as president, senator, and a member of the House of Representatives (67%). Republicans (72%) and Democrats (69%) agree equally with this idea. Sixty-one percent of Americans say when a Supreme Court Justice reaches a certain age they should be forced to retire at the end of the court’s term,” Ipsos said at the time.

“Again, Republicans (62%) and Democrats (67%) agree on this concept.
