President Donald Trump’s policy to restrict automatic birthright citizenship arrives at the U.S. Supreme Court in mid-May, pushing the debate back into the spotlight as legislation on the issue stalls in Congress.

Birthright citizenship is essentially the practice of having a child in America, despite neither parents being an American citizen, so that child can automatically become a citizen and then use this status for the rest of their lives. The process is colloquially known as “birth tourism,” and many are concerned the practice could be exploited by enemies of the state.

The legislation does not outlaw all non-citizens from giving birth in the U.S. and claiming citizenship for their child. Judges in several states pushed back against the policy, so now the case lands in the Supreme Court, according to Newsmax. “The administration asked the court to narrow the injunctions to let the government enforce Trump’s directive – part of his hardline approach to immigration – to the greatest extent possible while the legal fight over the policy plays out,” the outlet wrote.
